Terms and conditions

Article 1 - Product availability

Upon receipt of your order, we check the availability of the ordered product. We undertake within 10 days from the validation of the order: - to deliver the ordered product to you or to reimburse you. For any complaint, we advise you to send us a registered letter with acknowledgment of receipt, stating your order number, and indicating your contact details to the following address: FCtronic 2 Zone Artisanale 25320 Grandfontaine In case of out of stock on the one of the products, the order will be refunded.

Article 2 - Processing of the order:

The order will be validated: on the date of the order in the event of payment by online bank card or Paypal on the date of receipt of the check in the event of payment by check.

Article 3 - Order payment:

You can make payments: By credit card: Payment is made on the server of our partner Banque Populaire. We assure you that payment card details are encrypted and never pass unencrypted over the network. Payment is made directly to the bank. Payment by credit card is therefore perfectly secure, your order will be recorded and validated upon acceptance of payment by the bank. Via your PayPal account: PayPal allows you to pay online without providing your financial information during the transaction. Payments will be made to the address contact@nfelec.fr By check: Your order is then reserved for 8 days. Beyond this period, without receipt of your check, it will be canceled. The order will only be processed upon receipt of your check and after validation by our services.

Article 4 - Default of payment:

FCtronic reserves the right to refuse to make a delivery or to honor an order from a customer who has not fully or partially paid a previous order or with whom a payment dispute is being processed.

Article 5 - Delivery:

Delivery costs are calculated according to their weight and the delivery method selected when confirming your order. Delivery will be made by La Poste in colissimo followed or by carrier depending on the weight and volume of the product. The second carrier is DPD, which offers home delivery by appointment or at a relay point (addresses of relay points available on the DPD online application). For deliveries by carrier, check, in the presence of the delivery person, the number, condition and content of your packages. In the event of damage observed, you must mention precisely the date, the damage and make reservations on the delivery note. Otherwise, no complaint will be taken into account. It will be up to the buyer to provide all justifications as to the reality of the defects or anomalies observed. Delivery in Switzerland: customs clearance costs as well as the payment of local VAT are to be expected when shipping your order. Please contact the Swiss administration or the Swiss Post for more details on the conditions and rates applied.

Article 6 - Retention of title clause:

The products remain the property of FCtronic until full payment of the order.

Article 7 - Guarantees and responsibilities

A- FCtronic warranty New equipment for sale on the SAV-CAME site is guaranteed for 1 year from the date of purchase. Reconditioned equipment for sale on the SAV-CAME site is guaranteed for 3 months from the date of purchase. In the event of a breakdown during the initial warranty period, repairs will be provided free of charge by FCtronic. Only shipping costs will be borne by you. To be able to benefit from this guarantee, it is imperative to keep and provide the purchase invoice of the product when requesting coverage of the guarantee. The Guarantee does not apply for: Goods which cannot benefit from this contract Damage, breakdowns, failures or defects attributable to causes of external origin (incorrect application of the equipment, electrical surge, damage due to insects, etc.) Failures resulting from modification of the construction and original characteristics of the device. Failures affecting parts that do not comply with those recommended by the manufacturer. The adjustments accessible to the beneficiary without dismantling the device The costs of commissioning, adjustment, cleaning and tests not resulting from guaranteed damage. Failure to follow the manufacturer's instructions. Repairs and damage to the device after a repair carried out by anyone other than an employee of the NFelec company. Makeshift or temporary repairs as well as the consequences of any resulting aggravation of the damage. Damage due to corrosion, poor connection or a power supply problem (the power supply problem should be understood not to be a power supply problem internal to the product, but external to it) It is recalled that the benefit of the guarantee does not preclude the application of the legal provisions relating to the legal guarantee of conformity and the guarantee of hidden defects (legal guarantees) reproduced below. B-Legal guarantees You benefit from the provisions of the legal guarantee of conformity and the guarantee against hidden defects, provided for by the Consumer Code and the Civil Code: Compliance: Article L211-4 of the Consumer Code: The seller is bound to deliver goods that comply with the contract and respond to any lack of conformity existing at the time of delivery. It is also responsible for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to it by the contract or has been carried out under its responsibility. Article L211-5 of the Consumer Code: To comply with the contract, the good must: 1) Be suitable for the use usually expected of a similar good and, where applicable: - Correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model; - Present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling; 2) Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted. Article L211-12 of the Consumer Code: The action resulting from the lack of conformity lapses 2 years from the delivery of the goods. In order to benefit from this guarantee, you can contact our customer service directly by email from the SAV-CAME site. To facilitate and speed up the process, you will then be assigned a return number, which should be indicated when returning the product. You will be able to choose between replacing or repairing the returned product. However, under article L 211-9 of the Consumer Code, if the option you have chosen entails a disproportionate cost, we will use the other option. If, however, no repair or replacement is possible, or if the solution you have chosen cannot be implemented within one month of your complaint, or if this solution presents a major inconvenience for you given the nature of the good and the use you are looking for, you can then ask for the contract to be terminated. This resolution will not be pronounced if the defect is minor. If the resolution is pronounced, the price will be returned to you within 15 days of receipt of your return. Hidden defects: Article 1641 of the Civil Code: The seller is bound by the guarantee due to hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer cannot would not have acquired, or would have given a lower price, if he had known them. Article 1648 paragraph 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the buyer within 2 years from the discovery of the defect. In order to benefit from this guarantee, you can contact our customer service directly by email from the SAV-CAME site. To facilitate and speed up the process, you will then be assigned a return number, which should be indicated when returning the product. The fault and its origin are checked upon receipt of your product. The returned product, if it is affected by a hidden defect, will be refunded including postage, or exchanged according to your request and available stocks. The photos representing our products are not contractual. C- Responsibilities FCtronic cannot be held responsible for the partial application of the contract concluded, due to the occurrence of an event of force majeure. This force majeure event may be, depending on the circumstances, where appropriate a total or partial strike by the postal services, carriers, or a disaster caused by flood or fire. With regard to products purchased to meet professional needs, FCtronic will not incur any liability for any consequential damages as a result of the present, operating losses, loss of profits, damages or costs, which may occur. The choice and the purchase of a product are placed under the sole responsibility of the customer.

Article 8 - Right of withdrawal

In accordance with article L 121-20 of the Consumer Code, you have 7 clear days from receipt of the products to retract without reason and return the products to us. If this period expires on a Saturday, a Sunday or a public holiday, it is extended until the next working day. Beyond this period, no withdrawal will be accepted. You can exercise your right of withdrawal directly by email from the SAV-CAME site. To facilitate and speed up the process, you will then be assigned a return number, which should be indicated when returning the product. To be returned, the product must be complete, suitable for re-marketing, and returned in its original complete packaging. You bear the cost of returning the product. After offering you a credit note corresponding to the full price invoiced, and if you refuse it, we will reimburse the product returned by check, transfer or re-credit, at your convenience, as soon as possible.

Article 9 - Treatment of packages: NPAI / unclaimed / refused

If your package is returned by our service provider for the following reason: NPAI (Does not live at the Address Indicated) Package not claimed during its period of jurisdiction Package refused by the recipient during its delivery After receipt and acceptance of the return, we will proceed to a refund by check, transfer or re credit to your bank card.

Article 10 - Provisions of the law "data processing and freedoms":

At any time, “you have the right to access, modify, rectify and delete data concerning you (art 34 of the“ Informatiques et Libertés ”law of January 6, 1978). Following your first order, you will receive the info-offer from SAV-CAME. You can then change your subscription by clicking on the link at the bottom of each info-offer or by going to your personalized pages in your Account Customer Service.
